Article 1: object

 

The purpose of these general conditions of sale (hereinafter the "GTC") is, on the one hand, to inform any person of the terms and conditions under which the company Moppet Dolls (as defined below) offers to the sale and delivery to the Customer (as defined below) of Products Ordered via the Site and, on the other hand, to define the rights and obligations of the parties in connection with the sale of Products on the Site.

 

The fact for any Customer of Ordering a Product offered for sale on the Site implies full and complete acceptance of these T & Cs, which the Customer explicitly acknowledges having read before concluding an Order.

 

The Customer declares that:

 

- the purchase of Products on the Site is not directly related to a professional activity and is limited to strictly personal, non-commercial or lucrative, collective or associative use;

 

- be of legal age and have full legal capacity, allowing them to commit to the GTC.

 

Moppet Dolls reserves the right to modify the T & Cs at any time. However, only the GTCs accepted by the Customer at the time of the conclusion of the said Order will be applicable to an Order.

 

 

 

ARTICLE 2. Definitions

 

The terms capitalized in the GTC will have the meaning defined below:

 

"Moppet Dolls": Mme NATALIA DAVO, individual Entrepreneur company whose address is located Vallat des Horts, Route des Carmes, 30200 Sabran, France, registered with the RCS of Nimes under number 830 943 189 00019, without capital, represented by Madam Natalia DAVO.

 

“Customer”: any person who has placed an Order on the Site.

 

"User": any person browsing the Site without placing an Order.

 

“Order (e) e (r) (s)”: the contract concluded electronically on the Site, binding the Customer and Moppet Dolls for any sale via the Site of Products offered for sale on the Site.

 

“Products”: all the goods offered for sale on the Site and that the Customer can Order from Moppet Dolls.

 

"Site": under these T & Cs, the Moppet Dolls merchant website accessible at the main address: https://www.MoppetDolls.com.

 

"Territory": delivery area for Products Ordered via the Site, corresponding to the entire world.

 

 

 

ARTICLE 3. Formation of the contract and Orders

 

3.1. Prices

The selling prices of the Products, indicated in euros, are those in force at the time of validation of his Order by the Customer.

 

They do not include the costs of managing the Order and shipping the Products, invoiced in addition to the price of the Products, depending on the amount and composition of the Order. The management and shipping costs as well as the total price to be paid are indicated to the Customer before the conclusion of the Order.

 

The prices include the value added tax (VAT) applicable on the day of the Order. Any change in the applicable VAT rate will automatically be reflected in the price of the Products offered for sale on the Site.

 

The selling prices of the Products can be modified by Moppet Dolls at any time. The prices applicable to an Order are those indicated to the Customer in the summary preceding the conclusion of the Order by the Customer.

 

 

3.2. Product Features

In accordance with Article L. 111-1 of the Consumer Code, the Customer may, prior to any Order, find out on the Site of the essential characteristics of the Product (s).

 

The Customer selects one or more Products from the different categories offered on the Site.

 

The Products offered for sale on the Site may be Ordered within the limits of available stocks as established by Moppet Dolls daily between 00:00 and 06:00. In the event that an Ordered Product is temporarily or permanently out of stock, Moppet Dolls customer service will contact the Customer as soon as possible to warn them that their Order may not be honored within the time limits indicated or could be canceled. In these cases, the responsibility of Moppet Dolls can not be engaged. Where applicable, Moppet Dolls would also inform Users as soon as possible via the Site.

 

Moppet Dolls cannot be held responsible for any postponement or cancellation of the placing on the market of a Product.

 

If applicable, Moppet Dolls would inform Users as soon as possible and reimburse the Customers concerned in accordance with the provisions of Article 5.

 

In addition, in the event of non-substantial differences between the photos presenting the Products on its Site, texts and illustrations and the items Ordered, Moppet Dolls cannot be held liable, the photographs not being contractually binding on Moppet Dolls. Where applicable, the Customer has the right of withdrawal without reason or of cancellation, referred to in Article 5.6 below.

 

 

 

3.3. Ordered

Any Order assumes adherence to the GTC, without prejudice to any special conditions concluded between the parties, where applicable.

 

The Customer will have the opportunity to check the details of each Order prior to its validation by the latter. From the moment the Customer confirms an Order, he is considered to have knowingly accepted the GTC, the prices, volumes and quantities of the Products Ordered, as well as the fees and taxes applicable to his Order.

 

Each Order will be confirmed to the Customer by Moppet Dolls. In accordance with European regulations and French law, an Order is considered concluded (and the sales contract formed) when this Order confirmation is made available to the Customer by Moppet Dolls.

 

Moppet Dolls recommends that the Customer keep the information contained in the Order confirmation drawn up for his attention by Moppet Dolls on paper or computer.

 

Moppet Dolls sells the Products exclusively on the Site, at retail and to end-consumer Customers. Any Order that does not clearly correspond to a retail sale intended for the Territory and, more generally, any order that is fraudulent or suspected as such, will be considered by Moppet Dolls as null and void. If applicable, the Customer will be informed using the contact details provided to Moppet Dolls when placing their Order.

 

 

 

ARTICLE 4. Payment

 

All Orders are payable in euros. Payment is made at the time of the Order by the Customer, except as otherwise provided in the T & Cs or an explicit exemption granted by Moppet Dolls. At no time may the sums paid be considered as a deposit or down payment.

 

To pay for his Order, the Customer has the following payment and reduction methods: credit card, Paypal account, (see details in point 4.3 below), or any other means indicated during the ordering process.

 

 

4.1. Payment by credit card and Paypal account

The bank cards and electronic purses accepted on the Site are as follows: Carte Bleue, Visa, Master Card and PayPal, Google Pay, Apple Pay.

 

In order to ensure the security of payment by bank card, the Customer must send Moppet Dolls the visual cryptogram (CVV) of his bank card, during each payment transaction.

 

 

4.2. Vouchers

4.2.1. Conditions of use of vouchers

When the Customer benefits from a loyalty discount made available to him by Moppet Dolls, it appears on the Customer's personal account on the Site "www.Moppetdolls.com".

 

The loyalty discount is personal. It cannot be passed on to a third party. It can be used during a subsequent Order made by the Customer, within the time limit provided for by the loyalty discount.

 

Several loyalty discounts and Gift Cards may however be combined as a deduction from the payment of an Order, however limited to the price of the Products constituting said Order, excluding management and delivery costs for the Products Ordered.

 

Loyalty discounts and gift cards may in no case give rise to the payment of cash or a non-cash sum of money, nor result in the price of the Products Ordered and remaining due by the Customer, less vouchers. 'current purchases designated by the Customer for the Order concerned, ie less than 0 (zero) euros.

 

The cash value of a loyalty discount cannot be used partially. The loyalty discount can only be used once, on a single order, for its full value. Thus, if a Customer does not consume all of his loyalty discount during an Order, he loses the balance.

 

 

4.3. Payment security and general provisions

The Customer guarantees Moppet Dolls that he has the necessary authorizations to use the payment method he has chosen, among those available, when placing his Order.

 

Moppet Dolls reserves the right to suspend or cancel any execution and / or delivery of an Order, whatever its nature and level of execution, in the event of non-payment or partial payment of any sum that may be owed by the Customer to Moppet Dolls, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Site or the payment of an Order.

 

Penalties of an amount equal to the French legal interest in force are automatically applicable to the unpaid amounts at the end of a period of ten days following the date of the Order or upon notification of the rejection of bank payment for any other payment method.

 

Moppet Dolls reserves the right to request a photocopy of the Client's identity card and / or, if applicable, the bank card (front only) for any payment by bank card.

 

As part of the fight against fraud on the Internet, information relating to an Order and to the Customer concerned may be transmitted to any third party for verification purposes.

 

When a means of payment is issued by a banking or financial institution, only the means issued by such an authorized institution in France, Europe, United States of America, Canada or the United Kingdom are accepted by Moppet Dolls.

 

Moppet Dolls uses a secure payment tool, Stripe, a secure payment server, benefiting from 128-bit SSL (Secure Socket Layer) encryption throughout the transaction. Payment security is based on Customer authentication and the confidentiality of all data. To ensure this security, Stripe uses techniques known to be reliable cryptography and complies with the various applicable banking regulations.

 

 

 

ARTICLE 5. Delivery and reception

5.1. General rules

 

The Products will be delivered to the address indicated by the Customer when placing his Order, located in the Territory.

 

Moppet Dolls reserves the right to temporarily suspend a delivery area or delivery method.

 

By default, invoices are made available to the Customer in the “My account / my orders” section of the Site, accessible by the Customer upon indication of his personal and confidential identifiers. The Customer will be notified of the availability of his invoice when sending the dispatch message of his Order to the email address indicated by the Customer when registering on the Site, prior to placing his Order, or at the time of the Order.

 

Two "standard" delivery methods are available via La Poste / Delivengo ("my home delivered without signature", and one "Express" mode via ChronoPost

 

For any other question relating to delivery or its follow-up, Moppet Dolls invites its Customers to refer to the general conditions of carriers, accessible online.

 

In the event that the customer does not come to pick up his order within the availability periods as mentioned below in articles 5.2, 5.3 and 5.4, the Order will be automatically returned to Moppet Dolls at the end of this period. . The Customer will then be refunded the total amount of his order upon receipt of the package by Moppet Dolls.

If desired, the Customer may place a new Order, subject to product availability.

 

 

5.2. Standard delivery:

Via La Poste / Delivengo ("Home delivered without signature").

Delivery is made to the address indicated by the Customer during the Order designated by the Customer during the Order for a "Standard" delivery.

 

In addition to mainland France, all of the countries served by their Post are eligible.

In the case of standard delivery by "Domicile delivered without signature", and in the event of the Customer's absence, the Customer or the recipient of the Products Ordered receives a delivery notice allowing him to collect the Products Ordered at the Post office on closest indicated on the transit advice note, for a period of ten working days.

 

Moppet Dolls reserves the right to temporarily suspend a delivery area or delivery method.

Not all products on the site are available in all eligible countries.

 

 

5.3. Fast delivery: Chronopost

The Customer or the recipient of the Products Ordered is delivered to the address indicated when placing the Order, by a delivery person from Chronopost (hereinafter, the “Carrier”) and may be required to sign an acknowledgment of receipt. .

 

In case of absence, the Customer or the recipient of the Products Ordered receives a transit advice note, indicating that the nearest collection point or the date of the next visit.

5.4. Status of the Order delivered

 

The Customer or the recipient of the Products Ordered is invited to check the apparent condition of the Products at the time of delivery.

 

In the presence of an apparent anomaly (damage, product missing compared to the delivery note, damaged package, broken products, etc.) noted on delivery in the presence of the delivery person or the Carrier, the Customer or the recipient of the Products Ordered is required to report the damage, all complaints and reservations) and refuse delivery of the Products by immediately issuing a report of anomaly to the delivery person or the Carrier

 

The Customer or the recipient of the Products Ordered has a period of twenty-four(24) hours from receipt of the Order to inform Moppet Dolls, via Moppet Dolls Customer Service (at +33 6 95 22 38 36) or, by registered letter with acknowledgment of receipt to the following address: Natalia DAVO - Chemin de Cambon, 30200 SABRAN, France, of any incident relating to the condition or content of his package. 5.5. Delivery delay

- Australia, New Zealand and Oceania: 3 to 5 working days

- Pacific Asia: 3 to 5 working days

- Latin America and the Caribbean: 4 to 6 working days

- North Africa and the Middle East: 4 to 8 working days

- Sub-Saharan Africa: 4 to 8 working days

 

The deadlines announced above are valid for Products in stock at the time of the Order, for payment made online and outside periods of strikes, sales and Christmas, where the deadlines may be exceptionally extended.

 

Moppet Dolls cannot be held responsible in the event of late delivery due to an incomplete and / or incorrect address provided by the Customer.

 

For all practical purposes, the Customer acknowledges that the product delivery times indicated by Moppet Dolls do not constitute an essential condition of the Order contract.

 

 

5.5.2. Cancellation of an Order in the event of late delivery

If the delivery period applicable to an Order is exceeded not due to a case of force majeure or to an error made by the Customer (non-existent, incomplete or incorrect address), the Customer will have the possibility of canceling his Order (at the contact details indicated in the "Contact us" section of the Site or by calling +33 6 95 22 38 36 indicating to Moppet Dolls a reasonable additional delivery period for the Products Ordered. At the expiration of this new period, and in the absence of receipt of Products Ordered by the Customer, the order contract will be considered terminated.

 

In the event of receipt of the Products Ordered by the Customer before the expiry of this new period, if the Customer wishes to confirm the cancellation of the Order, the provisions specific to the right of withdrawal will apply, as referred to below.

 

When the contract is terminated by the Customer, under the conditions provided above, all sums paid will be refunded to him at the latest within fourteen days of the date on which the contract is terminated. Moppet Dolls will then proceed to an investigation with the Carrier or the delivery person concerned prior to reimbursement of the Products Ordered that have not been delivered.

 

 

5.6. Return of Products

Subject to the applicable legal guarantees, failing to comply with the terms of this article, the Customer may not make any other claim relating to the apparent defect of the Products delivered to him by Moppet Dolls, the Products then being deemed to be free from any apparent defect. .

 

No refund or exchange of a free premium can be made (except for a proven quality problem).

Products sold as a set of products (for example "Family of dolls" offers) cannot be returned individually for exchange or refund. All the products in the offer must be returned.

 

 

5.6.1. Withdrawal of an Order for delivered Products

The Customer has a period of 14 (fourteen) calendar days to withdraw from the contract without penalty and without giving any reason for exchange or refund, at the Customer's choice.

 

This period starts from the receipt of the goods by the Customer or a third party designated by him, other than the carrier. If the Products Ordered are delivered in several separate batches, the period of exercise of the right of withdrawal by the Customer runs from receipt of the last good.

 

Any return must first be reported to Customer Service using the form available online in the customer area, under "My Account / My Orders", available here

 

The Customer may also inform Moppet Dolls of his decision to withdraw by sending him the standard withdrawal form provided at the time of validation of the Order.

 

The Products must imperatively be returned to Moppet Dolls according to the procedure described in Article 5.6.2 below.

 

In the event of a total cancellation of an order containing a free premium, the Customer is invited to return to Moppet Dolls all of the products ordered, including the gifts in the package.

 

 

 

5.6.2. Return of Products conforming to the Order

When the Customer has exercised his rights of cancellation or withdrawal of an Order that has been fully or partially delivered to him, the Products subject to this cancellation or to this total or partial withdrawal of the Order may be returned by the Customer or recipient of the Products Ordered under the conditions and according to the instructions below.

The return of the Product to Moppet Dolls is carried out under the responsibility of the Customer. Consequently, Moppet Dolls recommends that the Customer entrust the return of the Product to a carrier allowing him to follow the return package sent to Moppet Dolls. Otherwise, if the return package shipped by the Customer does not reach Moppet Dolls, the Customer would not be able to question their carrier to locate the return package.

 

The transport costs of the return package remain the responsibility of the Customer. Moppet Dolls will reimburse the Customer for all sums paid during the Order, including the price of the Product (s) subject to the exercise of the right of withdrawal, as well as the amount of the shipping costs of the Products Ordered by the Customer. , calculated in proportion to the value of the Product (s) subject to the exercise of the right of withdrawal, as well as the value of the associated services ordered with the Product (gift wrap for example).

 

 

 

5.6.3. Return of Products following an anomaly in relation to the Order

In the event of an anomaly in the Products delivered compared to those ordered by the Customer, Moppet Dolls will attach to the Return slip sent to the Customer (such as that referred to in point 5.6.2 above), a label of prepaid return allowing payment of return costs. If the Customer decides to return his Order by a carrier other than the one prepaid by Moppet Dolls, he may under no circumstances request reimbursement of the costs of returning the Products to Moppet Dolls.

 

 

5.6.4. Control of Products returned to Moppet Dolls and reimbursement terms

Upon receipt of the return package, Moppet Dolls will check the compliance of the returned Product with the conditions set out in Article 5.6.2 above and the reason for return.

 

In the event of depreciation of the Product resulting from handling other than those necessary to establish its nature, characteristics and proper functioning, its return will be refused by Moppet Dolls and the Product will be made available to the Customer in Moppet Dolls' stock, or may be returned to the Customer, at his request and at his expense, within three months of receipt by Moppet Dolls of the Product returned by the Customer.

 

If, on the other hand, the returned Product justifies a refund, the Customer's refund will be made by the same means of payment as that used by the Customer when ordering, except for payment by check where the refund will be made by bank transfer. . The refund will be made, unless justified delay, no later than fourteen days from the date on which Moppet Dolls has been informed of its decision to withdraw by the Customer, in accordance with the above provisions.

 

However, Moppet Dolls may defer this reimbursement until recovery of the Product, or until the Customer has provided proof of shipment thereof, the date chosen being the first of these facts.

 

Moppet Dolls will reimburse the Customer for all sums paid, including the price of the Product (s) subject to the exercise of the right of withdrawal, any discount deducted, as well as the amount of the shipping costs of the Products Ordered by the Customer. , calculated in proportion to the value of the Product (s) subject to the exercise of the right of withdrawal.

 

In the event that a global discount has been applied to the order, the amount of the discount will be deducted from the value of the product to be reimbursed, calculated in proportion to the value of the Product (s) subject to the exercise of the right to withdrawal.

 

 

No partial refund can be made on products made up of several products (for example the "Family of Dolls ..." offers). All the products in the offer must be returned in order to proceed with the full refund.

 

In the event of late reimbursement by Moppet Dolls, the amounts due will be increased at a progressive interest rate in accordance with legal provisions.

 

 

 

5.7. Product exchanges

The Customer's exchange request must be made within 14 (fourteen) days from the date of delivery of the Product to the Customer and under the conditions described in article 5.6.4 above. If the Customer's Order for a new Product in exchange for a delivered Product is for an amount different from the delivered Product, the Customer will be reimbursed for the product originally ordered and a new Order must be made for the new Product.

 

 

5.8. Customs and import taxes

For orders made within the European Union, the 20% VAT rate is applicable and included in the total amount of your order. All orders outside the European Union are costed inclusive of VAT.

Any order placed on the site and delivered outside mainland France may be subject to possible taxes and customs duties linked to the delivery of the product. To know these terms, "MOPPET DOLLS" strongly advises the "buyer" to check with the competent authorities of his country, customs duties falling under the responsibility of the "buyer" and not being the responsibility of "MOPPET DOLLS". We are also not responsible for delays caused by the customs.

 

 

 

ARTICLE 6. Retention of title

 

Moppet Dolls retains full ownership of the Products Ordered until full payment of the full price of the Order, in principal (Products), costs and taxes included.

 

 

 

ARTICLE 7. Liability

 

Moppet Dolls cannot be held responsible for any indirect damage that may arise from the purchase of the Products. Likewise, Moppet Dolls cannot be held liable for the obligations of the GTCS in the event of the occurrence of a force majeure event as defined by the French courts. This provision is not intended to exclude the liability of Moppet Dolls from which it cannot be exonerated by virtue of the law, in particular in the event of fraud, serious misconduct, injury or death.

 

 

ARTICLE 8. Legal guarantee

 

These general conditions do not affect the provisions relating to the legal guarantees enjoyed by the Customer as a buyer of consumer goods.

 

Pursuant to articles L. 217-4 et seq. Of the Consumer Code, the Customer benefits from a legal guarantee of conformity which gives him the right to obtain the replacement or repair of the defective Product, within the limits set. by Article L. 217-9 of the Consumer Code.

 

The Customer is informed that he has a period of one (1) year from delivery of the Product to act, and that he is exempted from providing proof of the existence of the lack of conformity of the Product during the six months following delivery, this period being extended to twelve months from March 18, 2016, except for second-hand goods.

 

The legal guarantee of conformity applies independently of any commercial guarantee that may be granted by Moppet Dolls.

 

Under article 1641 of the Civil Code, the Customer also benefits from a legal guarantee against hidden defects.

 

The Customer has a period of one year from the discovery of the defect to activate this warranty, which allows him, according to the provisions of Article 1648 of the Civil Code, at his option, to return the Product and to be made of it. return the price, or keep the Product and have part of the price returned.

 

For the Grand Duchy of Luxembourg, the Civil Code allows the Customer to claim a hidden defect in the Product within one year from the notification of the defect to Moppet Dolls. This denunciation must take place within a short period of time from the moment when the Customer noticed the defect or from the moment when he should have noticed it.
